Like the nonprofit organizations that engage their services, professional fundraisers are subject to registration requirements which vary not only by state, but by how involved professional fundraisers are in the solicitation process.
Professional solicitors who engage in fundraising activities directly (e.g., making phone calls) are required to register in up to 43 states. Higher level strategists like fundraising consultants, also known as fundraising counsel, need to register in up to 31 states.
Keep in mind that the responsibility to disclose these relationships does apply to both fundraising professionals, and the organizations that contract their services.
